We may modify this Agreement at any time. Any modifications made to this Agreement will be effective immediately upon posting on the site. By accessing or using the Service, you agree to be bound by all of the terms and conditions of the Agreement as posted on the Service at the time of your access or use. You agree to review the Agreement posted on the Service each time you use the Service so that you are aware of any modifications made to this Agreement.
You must be 18 years old or older to purchase Services and located in the United States of America. Use of the Services requires a compatible, internet access, and certain software, and may require obtaining updates or upgrades from time to time. Because use of the Services involves hardware, software, and internet access, your ability to use the Services may be affected by the performance of these factors. You agree that such requirements are your responsibility. You agree to provide true, accurate, current and complete information about yourself when you register or order Services from us, and to promptly update such information to ensure that it remains true, accurate, current and complete. The charges in respect of our Services will be as set out on the website or in the application from time to time. We may vary subscription charges from time to time by posting new charges on the website or in the application. However, such variations will not affect Services for which you have already paid.
Communication Preferences. By using the HelpingHands service, you consent to receiving electronic communications from HelpingHands relating to your account. These communications may involve sending emails to your email address provided during registration or sending push notifications to your device or uploading new mobile applications to your device and are part of your relationship with HelpingHands. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing. You should maintain copies of electronic communications by printing a paper copy or saving an electronic copy. You also consent to receiving certain other communications from us, such as newsletters about new HelpingHands features and content, special offers, promotional announcements and customer surveys via email or other methods. If you no longer want to receive certain non-transactional communications, simply opt out of receiving further communications by contacting:

Membership, Billing and Cancellation
a. Ongoing Membership. After your initial month sign-up period, your HelpingHands membership will continue month to month unless and until you cancel your membership or we terminate it. You must have Internet access and provide us with a current, valid, accepted method of payment (as such may be updated from time to time, "Payment Method") to use the HelpingHands service. We will bill the monthly membership fee to your Payment Method.
c. We reserve the right to modify, terminate or otherwise amend our offered membership plans.
d. TO CANCEL YOUR SUBSCRIPTION, FOLLOW THE INSTRUCTIONS REGARDING CANCELLATION BELOW. We will continue to bill your Payment Method on a monthly basis for your membership fee until you cancel.
a. Recurring Billing. By starting your HelpingHands membership, you authorize us to charge you a monthly membership fee at the then current rate, and any other charges you may incur in connection with your use of the HelpingHands service to your Payment Method. You acknowledge that the amount billed each month and you authorize us to charge your Payment Method for such varying amounts, which may be billed monthly in one charge.
d. No Refunds. PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members ("credits"). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
e. Payment Methods. You may edit your Payment Method information by contacting customer service at firstname.lastname@example.org or calling 888-910-4668. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account (see, "Cancellation" below), you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates. If you signed up for HelpingHands using your account with a third party (i.e., iTunes, or similar account) as a Payment Method, and wish to cancel your HelpingHands membership at any time, you will need to do so through such third party, including by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from, the HelpingHands service. You may also find billing information about your HelpingHands membership by visiting your account with the applicable third party. For certain Payment Methods, the issuer of your Payment Method may charge you a fee or other charges. Check with your Payment Method service provider for details.
f. Cancellation. You may cancel your HelpingHands membership at any time after two months of service. You will continue to have access to the HelpingHands service through the end of your monthly billing period. If you decide to cancel your HelpingHands service within the month, you will be responsible for paying the remaining amount of the $29.95 monthly charge due at cancellation. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL MEMBERSHIP PERIODS. To cancel, contact customer service at 888-910-4668.
3. HelpingHands Service
b. The HelpingHands service, and any content viewed through our service, are for your personal and non-commercial use only. During your HelpingHands membership, we grant you a limited, non-exclusive, non-transferable, license to access the HelpingHands applications. Except for the foregoing limited license, no right, title or interest shall be transferred to you.
c. We continually update the HelpingHands service. In addition, we continually test various aspects of our service. We reserve the right to, and by using our service you agree that we may, include you in or exclude you from these tests without notice. We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we offer and operate our service.
e. HelpingHands software is developed by, or for, HelpingHands and is designed to enable HelpingHands applications through HelpingHands tablets devices. This software may vary by device and medium, and functionalities may also differ between devices. BY USING OUR SERVICE, YOU ACKNOWLEDGE AND AGREE TO THE END USER LICENSE AGREEMENT AND TO RECEIVE, WITHOUT FURTHER NOTICE OR PROMPTING, UPDATED VERSIONS OF THE PUZZLEPIECE AND RELATED THIRD-PARTY SOFTWARE. IF YOU DO NOT ACCEPT THE FOREGOING TERMS, DO NOT USE OUR SERVICE. WE DO NOT TAKE RESPONSIBILITY OR OTHERWISE WARRANT THE PERFORMANCE OF THESE DEVICES, INCLUDING THE CONTINUING COMPATIBILITY OF THE DEVICE WITH OUR SERVICE. By using our service, you agree to look solely to the entity that manufactured the device for any issues related to the device. If your HelpingHands ready device is sold, lost or stolen, please deactivate the HelpingHands ready device. If you fail to log out or deactivate your device, subsequent users may access the HelpingHands service through your account and may be able to access certain of your account information.
4. Account Access
a. You should be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by contacting customer service at email@example.com or calling 888-910-4668 and not through a hyperlink in an email or any other electronic communication, even if it looks official. In order to download new applications, you may receive an email with a link to download those applications from HelpingHands. HelpingHands reserves the right to place any account on hold anytime with or without notification to the member in order to protect itself and its partners from what it believes to be fraudulent activity. HelpingHands is not obligated to credit or discount a membership for holds placed on the account by either a representative of HelpingHands or by the automated processes of HelpingHands.
5. Disclaimers of Warranties and Limitations on Liability
THE PUZZLEPIECE SERVICE AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE PUZZLEPIECE SERVICE, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THAT MEANS THAT THE INFORMATION CONTAINED OR PROVIDED THROUGH THIS SERVICE IS INTENDED FOR GENERAL CONSUMER UNDERSTANDING AND EDUCATION. ANY ACCESS TO THIS SITE IS VOLUNTARY. WE WILL REGARD ALL ACCESS AS VOLUNTARY AND AT THE SOLE RISK OF THE USER. PUZZLEPIECE DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE PUZZLEPIECE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. PUZZLEPIECE SPECIFICALLY DISCLAIMS LIABILITY FOR THE USE OF APPLICATIONS, PUZZLEPIECE READY DEVICES, AND PUZZLEPIECE SOFTWARE (INCLUDING THEIR CONTINUING COMPATIBILITY WITH OUR SERVICE). TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL PUZZLEPIECE, OR ITS SUBSIDIARIES OR ANY OF THEIR SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR LICENSORS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
WE ARE NOT LIABLE TO ANY USER OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BASED ON RELIANCE UPON THE INFORMATION CONTAINED ON OR PROVIDED THROUGH THE SERVICE. Nothing contained in this site is or should be considered, or used as a substitute for, medical advice, diagnosis or treatment. This site and its services do not constitute the practice of any medical, nursing or other professional health care advice, diagnosis or treatment. IF YOU HAVE NOT PAID FOR THE SERVICES, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY NATURE; IF YOU HAVE PAID FOR THE SERVICES, OUR LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN RESPECT OF THOSE SERVICES.
WITH RESPECT TO ANY TABLET DEVICES PURCHASED FROM PUZZLEPIECE, PUZZLEPIECE’S limited warranty obligations are limited to exchange of the defective tablet if you are a current member and within one year of the purchase date. PUZZLEPIECE does not warrant devices for non-members or members who have cancelled their membership. PUZZLEPIECE does not warrant devices for damage due In no event shall HelpingHands be liable for more than a refund of the purchase price of the device. This warranty is not transferable. This warranty will be the purchasers' sole and exclusive remedy and we shall not be liable for any incidental or consequential damages or breach of any express or implied warranty of this product. PUZZLEPIECE shall not be liable for the loss of any saved/stored data in products that are either repaired or replaced. You may rely separately upon the manufacturer’s warranty. This Limited Warranty covers only manufacturer defects and does not cover: (a) defects or damage resulting from accident, misuse, abnormal use, abnormal conditions, improper storage, exposure to liquid, moisture, dampness, sand or dirt, neglect, or unusual physical, electrical or electromechanical stress; (b) scratches, dents and cosmetic damage; (c) defects or damage resulting from excessive force or use of a metallic object when pressing on a touch screen; (d) ordinary wear and tear; (e) batteries. THIS LIMITED WARRANTY SETS OUT THE FULL EXTENT OF PUZZLEPIECE’S RESPONSIBILITIES, AND THE EXCLUSIVE REMEDY REGARDING THE PRODUCTS. ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. IN NO EVENT SHALL SAMSUNG BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT OR FOR, WITHOUT LIMITATION, COMMERCIAL LOSS OF ANY SORT; LOSS OF USE, TIME, DATA, REPUTATION, OPPORTUNITY, GOODWILL, PROFITS OR SAVINGS; INCONVENIENCE; INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT. SOME STATES AND JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE DISCLAIMER OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND DISCLAIMERS MAY NOT APPLY TO YOU
You agree that this Agreement is entered into between you and us in the State of California, United States of America, and is performed within the State of California and governed by and shall be construed in all respects under the laws of the State of California, exclusive of its choice of law or conflict of laws provisions. In any claim or action by you directly or indirectly arising under this Agreement or related to the Service, you and we each irrevocably agree to submit to the exclusive personal jurisdiction of the California State District Court sitting in Riverside County, California, or if such court does not have subject matter jurisdiction, then you and we each irrevocably agree to submit to the exclusive personal jurisdiction of the United States Court for the Central District of California, and whichever of those two courts has jurisdiction, you and we each waive any jurisdictional, venue or inconvenient forum objections to such court.
If any of the provisions of this Agreement are held to be not enforceable by a court or other tribunal of competent jurisdiction, then such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
This Agreement constitutes the entire agreement between you and us relating to the access and use of the site and any of its services. This Agreement may not be modified, in whole or in part, except as described elsewhere in this Agreement. Anything contained on the Service inconsistent with or conflicting with the terms of this Agreement is superseded by the terms of this Agreement.
